KROQ to face $50 million lawsuit? by Julian Wass | 09.20.2004
An anonymous posting on morrissey-solo.com reported today that a $50M dollar class-action lawsuit will be filed against Los Angeles radio station KROQ. The lawsuit reportedly claims that KROQ "defrauded fans" by waiting 7 hours into this weekend's Inland Invasion concert to announce that Morrissey would not be able to perform; the singer was suffering from a high fever and sinusitis. Also reported to be in the petition is a claim that KROQ made $14M in food and beer sales during that 7 hour period.
According to NME.com, Morrissey was diagnosed with sinusitis at 11AM on Saturday, with a doctor's warning to avoid speaking for two full days. Still, the announcement was not made until much later in the day, as ex-Stone Roses singer Ian Brown told the 60,000+ crowd the disappointing news during his set. Fans were instructed to keep their ticket stubs, in anticipation of a replacement show. Whether or not the replacement show will affect the alleged lawsuit is yet to be determined.

September 21, 2004 Thank you to everyone for your kind letters of support and concern about Morrisseyâ??s well being. He sends his very best wishes and looks forward to seeing you all on tour over the next few months starting in Washington next week. What should have been a wonderful triumphant weekend playing to 35,000 of you in LA and 10,000 or you in San Francisco ended on Saturday morning with sinusitis, acute laryngitis and a high fever with orders from Dr Joseph Sugarman to get to bed and not speak for the next 48 hours at a minimum. Sadly we not only had to postpone the shows but also cancel (at great expense!) the video shoot for Let Me Kiss You which was due for Tuesday. The most important thing of course is Morrisseyâ??s health and we are happy to report that with the prescribed rest he will be ready to go next week and we will make an announcement later this week on a special event to make up for the KROQ show that all 35,000 of you who were there on Saturday will get to see and the same for the ALICE show in San Francisco. On a final note we understand that there are those in the Morrissey community on morrissey-solo.com spreading erroneous rumours about lawsuits and questioning whether KROQ did everything possible to bring you the information in a timely fashion. I can assure you that the rumours are false and the integrity of KROQ cannot be questioned. They handled a very difficult situation impeccably and you should treat anything you are told to the contrary as rubbish.

I just find it funny that hardcore Morrissey fans would deem the whole day a collosal and complete loss for which they must be compensated. Meanwhile, that "seven hours before an announcement was made" included performances by X, Franz Ferdinand, The Killers, Muse, Death Cab for Cutie and The Walkmen.

Merck is Morrissey's manager, huh? I think he managed the Pet Shop Boys at one point too, as well as Catherine Wheel. Not the warmest guy on the planet.

So talk on the Morrissey web site forum that he was on KROQ today announcing the make up date for the missed show out there….and he souned like ASS and said he was still feeling horrible. Hope this doesn't cancel tomorrow's show!!!

Speaking of tomorrow's show, there are 3rd & 4th row seats available at TM. Be warned - they're WAAAAAY off to the right. Possibly obstructed.
