Taping from the balcony?

I have a really shotty taping setup–Sony mics, musician's mic stand, etc. Would it be easier to record from the balcony? I was thinking I could use a short stand with a boom to extend it off of the balcony and over the crowd above. Would this be a bad/illegal move?
